Fastell Safety is a business in the Personal Protective Equipment industry that distributes PPE.

All references to “the Company””, “we”, “us” and “our” in these terms and conditions are deemed to refer to “Fastell” which is a Propriety Limited (PTY) LTD in the Republic of South Africa. All references to “you” and “your” are deemed to refer to any user and /or visitor of www.fastell.co.za (“Website”).

The Company permits the use of this Website subject to the Terms and Conditions (“Terms and Conditions”). By using this Website in any way, you shall be deemed to have accepted all the Terms and Conditions unconditionally. You must not use this Website if you do not agree to the Terms and Conditions.

You may only use the Website if you are 18 years of age or older. If you are under 18, you may use the Website only with the involvement of your parent or legal guardian.

Fastell Safety shall take all reasonable steps to protect the personal information of users. For the purpose of this clause,
"personal
information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be

Customer details will be stored by Fastell Safety separately from card details which are entered by the client on PayGate’s
secure site.

Card transactions will be acquired for Fastell Safety via PayGate (Pty) Ltd who are the approved payment gateway for all South
African
Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are
stored on the
website. Users may go to www.paygate.co.za to view their security certificate and security policy.

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency
is
South African Rand (ZAR).

Fastell Safety takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this
website,
customer service and support, dispute resolution and delivery of goods via our Courier Partner only.

The company shall not be liable for any direct, indirect, incidental, special or consequential injury, loss or damages which might arise from your use of, or reliance upon, any material or content contained in, or inability to use, and/or unlawful activity on, the website and/or any linked third party website. You hereby indemnify the company against any loss, claim or damage which may be suffered by yourself or any third party arising in any way from your use of this website and/or any linked third party website.

The Company reserves the right to update and/or amend the Terms and Conditions from time to time and without any notice, and you are accordingly encouraged to check the Website regularly. Any such change will only apply to your use of this Website after the change is displayed on this Website. If you use this Website after such updated or amended Terms and Conditions have been displayed on this Website, you will be deemed to have accepted such updates or amendments.

We will use reasonable endeavors to maintain the availability of the Website, except during scheduled maintenance periods, and reserve the right to discontinue providing the Website or any part thereof with or without notice to you. The Company may in its sole discretion terminate, suspend and modify this Website, with or without notice to you. These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa. Your continued use of the Website will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other, arising from any of these Terms and Conditions. 

These Terms and Conditions of Sale govern the sale of products (“Goods”) by the Company to you via the Website. Please note that while we will accept cash payments (over the bank counter or cash payment via ATM, Fastell will not carry the bank charges for this type of payment. This will be for the customers account. An order will not be released until bank charges are settled in full.

Once you accept these Terms and Conditions of Sale, you will be directed to a link to a secure site for payment of the applicable purchase price for the Goods.

Our relationship and/or any dispute arising from or in connection with these terms and conditions of sale shall be governed by the laws of the Republic of South Africa. You agree to be subject to the exclusive jurisdiction of the South African courts.

We take the security of your payment and personal information seriously. In this regard, you will be provided with a security certificate once you accept these terms and conditions of sale. All personal information that you provide to us is subject to our Privacy Policy, which can be faxed, posted or emailed to you on demand. However, due to the nature of the Internet, we cannot guarantee that your communications will be free from unauthorised access by third parties. Accordingly, we will not be liable for any loss or damages arising from third parties’ unauthorised access of your data.

Online orders: You may cancel for any reason within 7 days of delivery. We will refund you in full, less the cost of returning the goods if you use our courier. No handling fee applies.

Direct-marketing sales: If you bought because of direct marketing, you may cancel within 5 business days of delivery for a full refund. No handling fee applies.

Our goodwill policy (all other purchases): You may cancel/return within 7 days of delivery for a full refund. No handling fee applies.

We also accept change-of-mind returns from day 8 up to day 30 after delivery. A handling/restocking fee of up to 10% may apply.

– No fee if goods are unopened in original packaging.
– If opened but unused and resalable, we may deduct a reasonable amount for use and necessary restoration costs (capped at 10% in ordinary cases).
– Returns must include all accessories and original packaging and be clean and undamaged.

These deductions follow CPA section 20(6). Return shipping for change-of-mind is for the customer unless we agree otherwise.

Defective/unsafe goods (CPA s55 & s56): Within 6 months of delivery, if goods are defective or unsafe, you may choose a repair, replacement, or full refund.

No fees and we cover return/collection. Not as described / wrong item / not fit for stated purpose (CPA s20): Within 10 business days of delivery, you may return for a full refund, with return at our risk/expense. No handling fee; only statutory deductions allowed where applicable.

We cannot accept returns where law/regulation prohibits returns for health or safety reasons once supplied (e.g., certain PPE if packaging is opened), or for custom/special-order items that conform to your specifications.

Refunds are made to your original payment method within 10 business days of receiving/inspecting the return (statutory timeframes continue to apply where they’re stricter). We’ll let you know if any reasonable deduction applies under CPA s20(6) and why.

Returns can be booked through us (we’ll quote a courier fee) or sent to:

– Complies with Consumer Protection Act (68 of 2008) sections 16, 20, 55, and 56.
– Complies with Electronic Communications and Transactions Act (25 of 2002) section 44.
– Handling fees are limited to reasonable deductions and capped at 10%, ensuring compliance with CPA s20(6).

Delivery

We deliver to all cities in South Africa.

**Please note**

Courier companies do not deliver to P.O. Boxes or the post office, please provide a physical street address, thank you. The delivery is door to door.We no longer make use of the South African postal service due to unreliability.

Fastell makes use of Fastway Couriers as our preferred delivery partner.

Fastway delivers nationwide, with rates and services varying, based on the delivery address. 

After adding your desired products to cart, please navigate to the checkout page for a live delivery fee calculation.

We cannot give a time when the courier driver will arrive to deliver the parcel. There are so many factors which influence the delivery time such as traffic, delays at a previous stop or a technical problem.

Delivery will take place between business hours, from 08:00 to 17:00. Please ensure that someone is present at the delivery address to receive and sign for the parcel.

Courier delivery:

Courier companies do not deliver to P.O. Boxes or the post office. Someone must sign the waybill when receiving the parcel. If you cannot be present at the delivery address a work colleague or member of staff may sign on your behalf. Please note that shopping centres, estates, mines, universities and large companies are difficult deliveries and will usually result in delayed delivery if specific address and details are not provided.

We please ask that someone be present at the delivery address during working hours to receive the parcel.
